2003 Association News


Dear Treasurers:

The day that I have been dreading has arrived. Leola Harris has decided to retire, as of December 31, 2003.  Given Leola's unmatched expertise in bankruptcies, you can imagine what a loss this will be to my office, as well as to the Association.  She has decided that after 34 years on the job, the time has simply come to be able to spend more time with her family.

My office will be hosting a farewell event in Leola's honor on Thursday January 22nd, beginning with a ceremony at 11:00 a.m. in Mayor Hickenlooper's Office (at which everyone retiring from the county during December and January will be honored, along with other employees who have anniversaries of 20 years or more with Denver).  We will then have a reception at lunchtime here in my office.  As we get closer to the date, I will share the details with you.  But I know how much it would mean to Leola to have any of you join us.  I know too that she would love to hear from those of you who won't be able to make it to Denver join us that day.  She will be sorely missed!!

Just a note to let you know that when I called Barbara Kaiser, former Logan County Treasurer & Public Trustee, to share the information about Helen Zordel's passing, she said she was recuperating from a broken hip, cracked vertebrae and gall bladder surgery - doing quite well now and has been home for three weeks.  She sounded great and in good spirits.  Her address is 615

Lois Lipker, former Phillips County Treasurer, is still as lovely as ever but with white hair.  She proof reads for the Phillips County Abstract Office each morning.


I would like to inform the Associations of the passing of Helen Zordel, a former Pitkin County Treasurer and Public Trustee.  Helen passed away on December 8 and her services will be held Saturday, December 13, 2003 at 10:00 AM and St. Mary's Catholic Church in Aspen, Colorado.

Helen served as treasurer from May 1962 until March 1978.  She leaves behind two daughters and four grandchildren.  Helen's daughter Tina Zordel Gomez is a twenty year employee of Pitkin County and works with the Pitkin County Finance Office.

Jim is sending out 2003/2004 dues notices today.  The notice includes the $100.00 legal fee per our bylaws.  Since there is only to be one legal fee charged to each county, you can adjust the amount(s) due for any additional memberships.

I received this info from the Assessor.  As you know, Cheryl was a valuable member of both associations while treasurer/public trustee in Delta.  

I have the sad duty of letting all of you know that Cheryl Goad, Delta County Assessor, lost her husband early last week.  The funeral was on Thursday.  If you would like to send a card you can send it to:  Delta County Assessor, 510 Palmer St., Suite 210, Delta, CO  81416.

I would like to thank all of the people who volunteered their time at the IACREOT Conference last week.
It was a huge success and we could not have done it without all of your help.  I had numerous compliments about how nice it was and how friendly everyone was.  THANKS AGAIN !!!

The Legal Counsel and Legislative meeting will be held at Jefferson County on August 28th at 11:00 am.  We will start with the Legislative Committee and after lunch we will do the Legal Counsel Committee.  There will be a lunch charge of $10.00.  Please contact Tina Whitmer or Bob Sagel if you plan to attend.

The first E-Recording committee meeting will be held August 28, 2003 at 11:00am
at the Douglas County Events Center.  (Facility is just a few blocks off I-25
exit).  Please contact Jack Arrowsmith or Bob Sagel if you plan to attend.


On Wednesday, I attended a meeting of a subcommittee of the Real Estate Section of the Colorado Bar Association.  This is the second meeting of this committee, whose purpose is to review the changes created by SB 161 and work on any clean up of the statutes.  The following is a summary of the meeting.  The committee would welcome any comments and/or suggestions.  Please forward them to me.

of the Colorado Bar Association
July 16, 2003

Members of the committee attending were Bob Holmes, Larry Castle, Bob Brown, Michael Valdez, Rich Linquanti, Patrick Wheeler, and Rich Krohn (by telephone). Also attending were Debbie Wagner of Ackerman & Associates and Bob Sagel, CPTA president.

The committee reviewed suggestions for legislation previously submitted by members, decided which suggestions should be pursued for the upcoming session or set aside for further review, and assigned drafting responsibilities. Items that will be pursued and drafted are as follows:

    1. Procedures for "setting aside" a foreclosure sale arising from legitimate, inadvertent mistakes;
    2. Spelling out exactly when a redemption occurs and is effective;
    3. Adjusting the amount used to calculate a foreclosure fee from $400,000.00 to $480,000.00;
    4. Clarifying the treatment of excess funds when an owner redeems;
    5. Clarifying extensions of redemption periods in the event of bankruptcy;
    6. Clarifying which date to use for calculating the 15 day requirements when a the 15th day falls on a weekend or holiday;
    7. Procedures for accepting bids at a foreclosure sale, deadlines for payment, and what to do if the high bidder fails to make payment;
    8. Revising the types of costs and expenses that can be included in cure and redemption calculations;
    9. Clarifying requirements for supplying cure figures and how updates are handled;
    10. Some minor typographical errors in SB 161.

Items set aside for further review are as follows:

    1. E-recordings - the committee along with the Public Trustees' Association needs to get in contact with the Secretary of State, the Clerks' Association and the Title Company Association to be part of the process;
    2. Expanding the right to initiate a foreclosure without production of the original evidence of debt (the committee would like feedback from Public Trustees on this issue);
    3. Issues resulting from foreclosure of the priority portion of Homeowner Association covenant liens;
    4. Correct issues in the omitted parties section of the existing statutes.

The committee will meet again on August 27.


REMINDER - please try to get those registrations to me by June 6!!!  Also a REMINDER from District 5 -  all those Treasurers and Public Trustees who have a Name Tag - PLEASE BRING THEM ALONG AND WEAR THEM!  We have quite a number of new Treasurers and Public Trustees and this will help to get us all acquainted with each other.

I have heard from some "retired" Treasurers and hope that they will try to make at least one or two days of the Conference - How Exciting!!!

Well, if God willing and the Creek don't rise - we'll have ourselves a Conference in Canon City.


Jim wants to thank the Treasurers' and Public Trustees' Associations for the floral arrangements.  He is recovering slowly but surely and hopes to see everyone in Canon City. 


Karen Sheaffer's father passed away.  We all wish to express our deepest sympathy.  Cards may be sent to Eagle County Treasurer's office.


Thank you for your kind expression of sympathy by sending a beautiful bouquet of flowers when my brother died.  Your thoughtfulness is appreciated.


As I was going through my stacks of paper, I found where I told the group at Quadrennial that I would research Mobile Home title purges.  The following is the statutory reference.  It doesn't give much in the way of procedures.  In Morgan County, we first have the taxpayer make application with the Assessor so they can determine if it actually qualifies as real estate.  They then must have our office sign the application for purge so that we can collect all taxes due.  They then turn it over to the County Clerk to be sent to the State.

38-29-118. Surrender and cancellation of certificate - purge of certificate - penalty for violation.

(1) The owner of any manufactured home for which a Colorado certificate of title has been issued, upon the destruction or dismantling of said manufactured home or upon its being sold or otherwise disposed of as salvage, shall surrender his or her certificate of title thereto to the director with the request that such certificate of title be cancelled; and, upon said owner's procuring the consent thereto of the holders of any mortgages noted on the certificate of title and shown to be unreleased in the office of the director, such certificate may thereupon be cancelled. Any person who violates any of the provisions of this subsection (1) commits a class 1 petty offense and, upon conviction thereof, shall be punished as provided in section 18-1.3-503, C.R.S.

(2) The owner of any manufactured home for which a Colorado certificate of title has been issued, upon its being permanently affixed to the ground so that it is no longer capable of being drawn over the public highways, may surrender his certificate of title thereto and file with the authorized agent of the county or city and county in which such manufactured home is located a request for purging of the mobile home title; and, upon said owner's procuring the consent thereto of the holders of any mortgages noted on the certificate of title and shown to be unreleased, said manufactured home shall become real property. The provisions of articles 30 to 44 of this title and of any other law of this state shall be applicable to manufactured homes which have become real property pursuant to this subsection (2) and to instruments creating, disposing of, or otherwise affecting such real property wherever such provisions would be applicable to estates, rights, and interests in land or to instruments creating, disposing of, or otherwise affecting estates, rights, and interests in land.


NEED A HELPING HAND?

There have been some comments made that some County Treasurers and possibly staff would like to visit other counties to see how they operate their offices. This includes all sizes of counties. If you would be willing (as I know most of us would) to show others your operation, please let us know when you register at the summer conference and hopefully we can establish a list for those who would like to visit.

I will be presenting a full report at Conference regarding the just-ended
Legislative session. 

But in advance of that:  The most significant bill that passed which affects
us was Senate Bill 265, which eliminates the property tax exemption for
senior homeowners for the next 3 tax years (for taxes payable in 2004, 2005,
and 2006).  This was signed by the Governor on May 1.  We will have
information at Conference as to what administrative steps regarding the
exemptions will still have to take place for Assessors and Treasurers during
these next 3 years.  Also, we will be writing some sort of brief notice to
taxpayers that you could include with your tax notices in January, that will
make clear that the exemption has gone away because of an act of the State
Legislature and the State's budget problems - - rather than because of any
decision at the County level.

Both Executive Boards met with District 2 to finalize plans for the summer conference in Canon City and everything looks very good.  It should be an informative and fun time.  Registration information should be going out very soon.

I've been in touch with Leslie Sloss at the State Treasurer's office concerning the Homestead exemption files.  His statement is: The occupant, property and total files need to be sent email as a text file.  The letter stating what the county is expected to be paid can be sent either by email with an electronic signature of the County Treasurer or by hard copy to be sent to:

REMINDER!  You need to send the Senior Exemption report to the State Treasurer by April 1st.


Just a couple notes:
1)  I forgot to change my email address on the registration form.  Please use phillipstres@pctc.net from now on.
2)  Member counties with new officials need to let me know how they want their names on their badges.  Anyone else wanting a badge may order one but at their own expense.  If ordered together, the cost may be as low as $7.50 - alone at least $10.50.
3)  Be thinking about our financial situation.  We have excess funds.  I plan to bring up the possibility of granting a large amount to the Public Trustee Legal Fund.  And also perhaps we should lower our membership fees now if we don't need the money and many of us are scrambling for budget funds.
