Message from the President

Greetings to All,

 

I hope everyone had a wonderful Holiday Season and a great January.

 

I am halfway through the year as president of the Public Trustee Association and wanted to take a few minutes to get some information out to everyone and say "Hello".

 

Thanks to all of you who have participated with the email exchanges of questions and answers.  I feel it is a valuable tool and helps to keep us in touch.   I have about three (3) questions that we have not gotten consistent answers to and will continue to compile them for Rich to answer at the June conference.  Please send me any additional questions you have for him.

 

I need to say a big thank you to several of the committees for all their hard work.  The forms committee, the e-business committee and, last but not least, the legislative committee.  These committees have been meeting on a regular basis and have accomplished so much.  There are brief reports from each of these committees with this newsletter, so you will see how busy they have been.

 

Everyone should have received the last two pages of the manual - Thanks Patty for getting those out to everyone.  These were the pages on bankruptcy.  If you did not receive them, let me or Patty

Bartlett from Logan County know and we will get them to you.

 

As we get closer to the June meeting, I will be contacting the committee chairs to see what work needs to be done, if any.

 

The nominating committee will be contacting members to run for officers for the next year.  If you are interested in running for an office please contact the chair of that committee, Susan Cochell at (719) 523-4262.

 

I am in touch with Sandy Greenlee and her deputy, Sharon, regarding the summer conference and will get things finalized in the near future.

 

Keep in mind the upcoming events and check the website for registration and information.

 

Eastern Division - March 24th & 25th - Holly Williams, El Paso County is in charge of this.

 

Summer Conference - June 20th - 24th - Montezuma County

Treasurer's Report
Jim Covington

The Public Trustee dues are due and payable.  Remember to be a voting member the dues must be paid at the time of the vote.  If you have not paid your Public Trustee dues please mail to Jim as soon as possible.


Forms Committee Report
Alynn Huffman, Chair

The release forms are completed and distributed to PT's.  We removed the Bradford Publishing numbers.  The forms have been sent to Kuvera for the electronic recording and the committee is waiting for a reply.  Alynn, Jack Arrowsmith (Douglas County Public Trustee), and Jim Wills (Boulder County Deputy Public Trustee and Chair of the e-Business Committee) will be attending the Public Records Industry Association meeting in March.  The release forms will be presented so they will be aware of the release industry in Colorado and what we are doing.  The forms were given to the Clerk and Recorders for review at their conference that was held in January.  The committee has not received any feedback from them.


Legislative Committee Report

By now, HB 05-1168 should have passed first reading in Committee and be well on its way to passing out of the House.  Rep. Michael Garcia sponsored the bill on behalf of the Public Trustees’ Association and Sen. Ken Kester will carry the bill in the Senate.  We owe both of these gentlemen a big “THANK YOU” for their help.  I would also like to thank the Real Estate Section of the Colorado Bar Association for their assistance in preparing this bill.  But most of all, I feel the Association owes a great debt of gratitude to their Legislative Committee and especially to Peg Ackerman and Debbie Wagner.  They have been of immense help in getting this bill introduced.  The embryonic journey of this legislation was very challenging due to some miscommunications and misunderstandings, but it got there and I think it will be very helpful to us all.

 

Because of the time consumed in getting our Housekeeping bill off the ground, we had to put the proposal to extend the cure period and eliminate the owner’s redemption period on the back burner.  Also, the Bar Committee brought forth numerous possible changes to the foreclosure statutes.  As such, we will be meeting with the Bar Committee on a monthly basis to prepare legislative proposals for next year’s session.  We plan to have a preliminary draft ready to discuss at Convention in June.  This will allow everyone plenty of time to study the proposals and provide input to the Legislative Committee.

 

If any of you have ideas for changes to Title 38, or if you have questions or concerns, please get them to me or one of the Legislative Committee members and we will do our best to address them.


eBusiness Committee Report
Jim Wills, Chair

Boulder, Douglas and Weld County Public Trustees are processing releases electronically and are seeing an increasing number.  We are expecting Denver and a few more counties to be on shortly.  Several other counties have shown interest in the e-filing process.

 

Thanks Allyn Huffman (Gilpin County) and Jill Voegtle (Castle, Meinhold & Stawiarski) for putting forth much time and effort to create the release forms.  Thanks also to all the Treasurers and Public Trustees who provided input on the new forms.  Once the new forms have been used for a few months, the eBusiness Committee will recommend that the new forms be mandatory.

 

The eBusiness Committee is currently addressing the issues concerning the electronic submission of foreclosure packages as a means to ease the data entry burden of the Treasurer and Public Trustee office staff.

 

A reminder - contact your Clerk and Recorder if you desire to seek funds from the Electronic Technology Fund for your electronic recording system.  The statute does not permit the Treasurers and Public Trustees to directly apply for the funds.

News from Members

Karen Sheaffer (Eagle County Treasurer and Public Trustee) has been re-elected to the position of Board Member to COLOTRUST - Congratulations!!

 

Angela Dazlich (Larimer County Public Trustee):   Our son Dave graduated from Congressional Page School on January 28th.  Congresswoman Marilyn Musgrave appointed him.  Way to go, Dave!!

 

Linda Statz (Phillips County Treasurer and Public Trustee) says thanks for asking about my husband, Ralph.  This is what she reports:

We just came from the doctor who bluntly told us there is nothing they can do for him.  He has damaged lungs (smoking for 40 years) and a congeniatl heart problem.  He is unable to do more than walk across the room with oxygen.  We are applying for medical disability and learning to live with the fact that he will probably never get better.  He has no pain, just shortness of breath, and may get a transtrachicial (oxygen direct to lungs rather than wearing nasal canula).  He spends his day watching television or playing computer Solitaire.  You can tell the group that he feels fine but can't do anything; and we are hoping to qualify for disability.

Linda, we will keep you and Ralph in our thoughts and prayers.

Yes, I am moving to a tiny condo to simplify my life.  Has anyone lived in their house over 25 years and not been able to throw anything away?  I can't believe I have attached myself to so many material items.  I don't have time to sort through everything at this moment, so will have to throw out most of it later.
