Message from the President

 

Spring is finally here!  It’s time to get out in the yard and overwork your back and knees.  Speaking of overworked, I hope you are all seeing a decrease in the volume of releases and foreclosures. 

 

In case you haven’t heard, Rich Krohn was contracted as the Association’s attorney for the remainder of this fiscal year.  Rich has served us well in the past and I am excited to have him back on board.  He also serves on the real estate section of the Colorado Bar Association and will continue to watch out for our interests in that capacity. 

 

The E-Business Committee has continued to meet on a regular basis.  They have been working with the Secretary of State, the County Clerks’ Association, the Colorado Bar Association, the Title Company’s Association, as well as private vendors to get the ball rolling and make e-business a reality for Colorado.  If you see any of these committee members, please give them a big thank you for their hard work and diligence.  One of the roadblocks they have encountered is e-notarization.  Below is a copy of an opinion Rich supplied at my request.  I will ask the Manual Committee to include this in the update.

 

Along that same line, the Legislative Committee met on March 17th  (see the minutes) and one of the items discussed was the notary requirement for releases.  On March 23rd, Jack Arrowsmith, Peg Ackerman and her associate, Debbie Wagner, and I met with Rich Krohn, Larry Castle, Mike Shea from the Secretary of State’s office, Michael Valdez with the Colorado Bar Association, Carole Murray from the Clerks’ Association and Mark from LTAC.  The group decided to seek an amendment to HB 1300 allowing PT’s, Sheriffs and Treasurers to substitute their seal, registered with the Secretary of State, for any acknowledgements required by law.  Rich and Larry will draft language and submit it for everyone’s approval.

 

It’s time to start making plans for the summer conference.  I know Roxy has been working hard to provide us with an informative and entertaining time, so I hope you all can make it.  If you have any suggestions of things you would like to discuss or see covered, please let me know.  As of now, I plan to have Rich do a Q & A session.  He has asked that questions be submitted in advance, if possible, so he can research the answers.  Send your questions to me and I will get them to Rich.
