ANNUAL SEMINAR
THURSDAY OCTOBER 14, 2004
FORT COLLINS MARRIOTT

The meeting was called to order and President Peggy Foley, Pueblo County, welcomed the membership.  Myrna Rodenberger and her staff from Larimer County were thanked for organizing another amazing seminar.  Our sponsors, Tyler Technology, Jeff Willie/Cuvera, John Lough/ACS Government Information Services, Lyn Jane Way were thanked for the continued support of our association.

Mack Crowther, Conjeos County, led the invocation.

Tina Whitmer, Grand County, led the Pledge of Allegiance.

Jamie Crocket, Jackson County, called the roll, and found 51 counties present.  The minutes of the June conference were approved as presented.

Jim Covington, Lincoln County, gave the Treasurers’ report.  As of October 8, 2004 the Association had a balance of $51,736.88 and all bills to date have been paid.  Jim reminded the association the Legal Fund dues are $50.00 this year.

Peggy Foley reported on the Executive Board meeting.  Mike Coffman, State Treasurer, has offered to provide general guidelines for all counties regarding account procedures in the public trustee office.  Bob Sagel updated the exec. Board on the legislative committee.  They have met 3 times since June.

Forms committee

Alynn Huffman, Gilpin County, handed out drafts of new release request forms. The drafts allow for either full or partial release requests, with or without evidence of debt. One form was for electronically transmitted release requests. A suggested title for the forms is: Request for Full / Partial Release of Deed of Trust.  The drafts of the forms will be given to Rich Krohn to proof and will be faxed or e-mailed to all counties for a vote of approval in the same manner.   It is hoped we will be able to have new forms by the first of next year.

 Manual Committee

Patty Bartlett, Logan County, introduced Rich Krohn.  Rich presented the bankruptcy portion for the manual.  Following discussion and additions for the last page the manual passed unanimously.  All association members will be sent the corrected pages.

Legislative Committee

Bob Sagel, Morgan County, reported the committee had two bills in the works, one  regarding the housekeeping bill to clean up language and the other gives Public Trustees authority to withdraw a foreclosure sale if the attorney does not withdraw within a specific time frame. A vote of those present approved moving ahead with both bills.

The possibility of lengthening the cure period or shortening the owner redemption or eliminating it all together was brought up.  Lowering the fee structure for e- releases was discussed, as well as increasing the fee for foreclosures.  The Executive Board has requested this issue be put on hold for more data on e-releases. 

The next meeting is scheduled for November 18, 2003 at noon in Jefferson Co.  Meeting dates and times will be posted in the web site, www.e-ccta.org. 

Bylaws Committee

Changes to the bylaws were mailed out to the association membership 30 days prior to this meeting.  The changes were regarding the contract dates for the legal advisor and legislative lobbyist.  The changes to the bylaws were approved by the membership in attendance. 

e-Business Committee

Jack Arrowsmith, Douglas County; Jeff Willie, Cuvera; John Lough, ACS Government Information Services; Jim Willis, Boulder County presented a live demonstration of an electronically release of deed of trust, and answered questions.  Dana Williams, Director of Administration for Donetta Davidson-Secretary of State gave a presentation on the importance of Public Trustee/County Clerk relationships and grant proposals for help with implementing e-business.
