COLORADO PUBLIC TRUSTEE’S ASSOCIATION
FALL SEMINAR
THURSDAY, OCTOBER 19, 2006
MARRIOTT HOTEL
FORT COLLINS, COLORADO

The meeting was called to order by President Jamie Crockett, Jackson County.

The INVOCATION was given my Mack Crowther, Conejos County and the PLEDGE OF ALLEGIANCE was led by Alta Mae Brown, Bent County.

ROLL CALL was taken by the secretary, Sandra Berry and showed that 51 counties were present.

A motion was made to waive the reading of the MINUTES and to approve them as presented. Motion seconded and was passed.

The FINANCIAL REPORT was given by Jim Covington.  The balance that the Association has in all accounts is $61,955.85. A complete copy of the report is attached.

Jim also reported that the Association had received a $5,000.00 donation from Castle Meinhold and Stawiarski LLC.

Jim Covington announced that the sign up sheets for CONTINUING EDUCATION credit was in the back of the room and that they need to be signed when everyone left after the conclusion of the presentations.  He also stated that he had the approval of the Treasurer’s Association to buy a small laptop and printer so that the continuing education paperwork could be completed at the meetings rather than mailing forms back and forth and asked if the Public Trustees’ Association would agree to pay half of the cost.  The motion was made for the Association to pay half of the cost.  Motion Seconded and passed.

The LEGISLATIVE REPORT was given by Bob Sagel, Morgan County.  He stated that Representative Garcia had agreed to carry the Association’s cleanup legislation for HB 1387 and that the Association was presenting him with a plaque as Legislator of the Year named by the CPTA.  The Legislative Committee had met and that the following legislation had been proposed.

* Change the release statutes to require that releases used be “substantially in the form” of the form adopted by the CPTA.

* To remove all redemption rights after the foreclosure sale.  Junior lienors would have the right to bid at the sale. (It was discussed that this might be added to the cleanup legislation for HB 1387

* Cleanup of HB 1387 to correct unintended or omitted items that were overlooked in the processing of such comprehensive legislation.  Including but not limited to the following:

A reminder was given that the last training meeting on the changes brought about by HB 1387 was going to be December 15th in Douglas County, hosted by Jack Arrowsmith.

Debbie Wagner from Ackerman Information Inc. informed us that she and Peg would be working with Representative Garcia on the clean up bill.  The bill needed to have a title by December 1st and the drafting had to be finalized by January 1st.

Bob led the group in discussion on different problems with the statutes in regards to Releases of Deeds of Trust that also needed to be addressed to reflect the changes brought about by form changes and erecording.  The motion was made for the Legislative Committee to look at clean up legislation concerning Releases of Deeds of Trust.  Motion Seconded and passed.

Jim Covington announced that there was still money left in the scholarship fund provided by Colorado Mortgage Lenders Association for the training meeting on HB 1387 to be held in Douglas County on December 15, 2006.

Angela Dazlich told the group that Larimer County had hired Rich Krohn to give them a comprehensive opinion regarding MERS (Mortgage Electronic Registration Systems) releases and it was suggested that the Association contract with Rich to provide the information to all the PTs.  Motion was made, Seconded and passed.  Rich agreed to provide the information for $500 upon receiving a written request from the Association.

The meeting was adjourned by President Jamie Crockett.
