COLORADO PUBLIC TRUSTEES’ ASSOCIATION
FALL SEMINAR
FORT COLLINS COLORADO
OCTOBER 25, 2007

The meeting was called to order by President Jim Covington.

The Star Spangled Banner was sung by Bob Sage!, Susan Cochell, and Dee Ann Stults

The Invocation was given by Mack Crowther.

The Roll Call was taken by secretary, Dee Ann Stults, and showed that 55 counties were present.

The Treasurer’s Report was given by Michelle Miller. A copy of the complete report is attached.

Executive Board Report was given by Sandra Berry. The board met July 25th and again September 20th.  The board voted to acquire a debit card since many places no longer take checks. Each district chairman was asked to set up a time and place for the Public Trustee Foreclosure training before the first of the year. After the district meetings there will be an Eastern and a Western regional meeting to answer any legal questions that may have come up at the district meetings. A donation of $2,500 was received from GTS and a $5,000 donation from CMS and $1,000 from Robert Hopp. This money will be used to pay for the expenses of training for the new foreclosure statutes. The board also discussed a by-laws request and decided to table it at this time. Discussion about having Rich Krohn put a disclaimer in the front of the PT Manuel was held. The board will ask Rich to get a disclaimer written up.

The District Training Meetings are as follows:

 

Bob Sagel will put the dates and times on the website.  The trainers are Rich Krohn, Ed Murray, Bob Slade, Bob Sagel and Jim Covington. The training meetings will be on the new procedures and if legal questions come up please get them to Jim Covington and he will pass them on to Rich Krohn and the answers will then go out to the entire association.

 

Jim Covington reported that Charlotte O’Donnell from the Colorado Mortgage Lenders Association had approached him about a $500 donation to help cover the cost of mailings for a seminar they are holding. Carol Snyder moved to not provide them with the donation. Ed Murray seconded. Discussion followed. Motion passed.

Forms Committee
Georgia Chamberlain reported on the combined notice of rights and notice of sale and the scriveners’ error affidavit. Carol Snyder from Adams County offered her scriveners’ error form for the association to use if they chose.

Legislative Committee
Bob Sagel reported that they had met with the Bar committee and they will be letting the changes go into effect and see how they work and then go in and do a fix on the necessary items. The salary increase for the Appointed Public Trustees is going forward. Bob reminded the group that he still needs their cutoff dates for recording the NED’ s in December from a few counties and that since Christmas and New Year’s fall on a Tuesday to adjust any dates so that we are in compliance with the statutes.


The Continuing Education Committee met and staff can now acquire credits toward a certificate. Staff must be a dues paying member of the association to receive the credits.

Manual Committee
Patty Bartlett reported that she has a rough draft ready and is working on the final copy. When it is ready it will be e-mailed to the members. Bill Wallace moved to change the name of the manual to Public Trustee Guidelines with the disclaimer in the front. Diane Bailey seconded. Much discussion followed. Rich Krohn gave an opinion about the manual and the Colorado Open Records Act. The request MUST be made correctly before any document is given to the person requesting the document. Bill Wallace amended his motion to having the manual be called Public Trustee Suggested Guidelines. Dianne Bailey seconded. The amendment was passed along with the motion. Alynn Huffman moved that we only give out the manual on a Colorado Open Records Act request and not sell it and charge the $0.25 cents per page copy allowed. Kerry Carl seconded. Discussion followed. Alynn Huffman withdrew her motion and then moved that we DO NOT SELL the Public Trustee Suggested Guidelines. Margaret Chapman seconded. Motion passed. Each individual county is responsible for their Colorado Open Records Act request.

Following the committee reports a get well card for Bev Woodard (Chuck’s wife) was passed around for all to sign.
