ANNUAL SEMINAR

THURSDAY OCTOBER 23, 2003

FORT COLLINS MARRIOTT

 The meeting was called to order and President Bob Sagel, Morgan County, welcomed the membership.  Myrna Rodenberger and her staff from Larimer County were thanked for organizing another amazing seminar.  Our sponsors, Eagle Computer Systems and The Colorado Bar Association-Real Estate Section were thanked for the continued support of our association.

Mack Crowther, Conjeos County, led the invocation.

Peggy Foley, Pueblo County, led the Pledge of Allegiance.

Jamie Crocket, Jackson County, called the roll, and found 53 counties present.  The minutes of the June conference were approved as presented.

Jim Covington, Lincoln County, gave the Treasurers’ report.  As of October 17, 2003 the Association had a balance of $39,436.04 and all bills to date have been paid.

Bob Sagel reported on the Executive Board meeting. Jim Covington reminded the membership of the legal fund dues of $100.00 this year and $50.00 for subsequent years.

Forms committee

Georgia Chamberlain, Garfield County, handed out new forms, both full and partial release requests, for the title companies to use.  Bradford helped with the format and additions that would be a legal issue.  Bradford has indicated to Bob Sagel they would make a CD of all relevant PT forms available to Colorado Public Trustees for $100.00 a year (including any mid year revisions).

 Manual Committee

Kerry Carl, Hinsdale County, will remove the section regarding keeping record of releases.  The manual committee has never approved the new manual.  The committee will report back to the Association in June regarding a  vote to accept the new manual.

Legislative Committee

Karen Sheaffer, Eagle County, handed out information from Peg Ackerman with her web site address; the deadline for 2004 legislation at general assembly; suggested changes to PT fees statute; proposed revisions regarding cure and redemption periods.  The minutes of the August 8, 2003 meeting are on the PT web site.  It has been suggested the Public Trustee Association draft a letter to the Bar Association regarding legislation being introduced.  It is not productive legislation if both associations are not in agreement.  The only proposed legislation this coming year will be from CCI regarding fiscal responsibility and reporting.

Legal Counsel

Chairperson Tina Whitmer, Grand County, was not in attendance.  Bob Sagel reported the counsel discussed the formation of the committee to obtain legal counsel.  Rich Krohn has been contacted regarding representing us again.  He has indicated he is not opposed to this however nothing else has been done.

Questions that need opinions from legal counsel have been raised.  Sandy Hume, Boulder County, would like the association to be able to provide a united opinion.  He proposed and moved to authorize the Executive Committee and the Legal Counsel Committee to hire legal counsel.  Georgia Chamberlain seconded motion.  Discussion followed, hand count was called for, and 27 favored the motion, 16 opposed.  The Executive and Legal Counsel committees will pursue legal counsel.

Roxie Huber, Broomfield County, gave dates for June 2004 Conference.  It will be in Westminster CO June 21-25 at the Double Tree Inn, $79/night rate.  Public Trustee day will be June 24th

Jack Arrowsmith, Douglas County, presented the program on E-Recording Committee Report and Panel Discussion.  Handouts were distributed regarding the process.  Douglas County Clerk and Recorder office has already implemented this; Boulder County is not far behind. 

A roundtable discussion on foreclosures followed the Association Lunch.
