Minutes of Public Trustee Executive Committee Meeting
September 11, 2008

 

Sandra Berry, President, called the meeting to order at the Holiday Inn Express in Limon at 10:05 a.m.  Present at the meeting were:  Sandra Berry, Connie Joiner, Michelle Miller, DeeAnn Stults, Jim Covington, and Patty Bartlett.  Also, present were Bob Sagel and Linda Statz.

 

Sandra stated that the meeting was called to consider signing the proposed contract with Ackerman Information Corporation as lobbyist for the Association.  Discussion was held about past years amounts paid.  Jim questioned about this coming about at the same time as a similar increase for the Treasurers.  Bob made everyone aware that Tom Hill is a lobbyist for Castle but if there is a conflict, he is to stand with the Public Trustees.  Bob also stated that they will need to hire someone else to take Debbie Wagner’s place.  Jim questioned if Peg has been completely watching out for our best interests over the years – it seems as though sometimes she was not on top of everything.  DeeAnn moved and Connie seconded to retain Ackerman Information Corporation and to authorize the President to sign the contract with Ackerman Information Corporation. Motion passed.

 

Discussion was held about having trouble with the post office delivering to street address.  Bob discussed e-mail from Dianne Bailey about title vesting.  The question is should it be allowed for the Certificate of Purchase holder to pay off junior liens during the eight day period particularly HOA liens.  Explain how many days before a Deed can be issued and if they have not moved, an eviction may be done.  We should take position that it is not the Public Trustee’s concern as to what happens after the sale and particularly after the eight-day period.  Bob changed his earlier opinion and now has decided that he does not want to take this question to Rich for an opinion.

 

Linda brought up a concern with deficiencies.  Should some of these situations be reported to the Attorney General if there are illegal things going on – not just if we feel it is not right.  Jim stated an attorney told him that every time you question something, you open yourself up for legal liability.

 

Sandra reminded everyone about the Legislative meeting on September 25 in Weld County and then adjourned meeting at 10:30.
