DISCUSSION ITEMS

·         Problem Properties

There was discussion on protecting problem properties.  The state of Minnesota has introduced legislation regarding how cities can secure foreclosed and abandoned properties so they cannot be used for improper purposes in troubled areas.  Legislation may be proposed in Colorado trying to pattern legislation on the Minnesota law.  The agreement of the public trustees group is to see this legislation defeated but would be difficult because CCI and CML would be in favor of this legislation.  A problem would be how to determine whether property is abandoned.  If the legislation called for judicial foreclosures on abandoned properties, then the public trustees would be neutral. 

 

·         HB 1276

There was a meeting with Representative Ferrandino regarding issues with this bill.  Public trustees are working through the issues.  There are a lot of gaps, vagaries and silences in the bill.  The bill has no regulatory authority for implementation.  Ferrandino may sponsor a bill to give the Division of Housing regulatory authority. There will be a cleanup bill to get some of the issues addressed.

 

·         County Clerk Fees

Rep. Judd will sponsor new legislation next session to address consistency in county clerk fee structure for the grantor/grantee issue.  There is agreement for a flat fee of $10 for the first page plus $1.00 so $11 for first page, and $5.00 for each additional page, to make this revenue neutral.
