The following items were discussed:
Create statute to allow e-recording of Releases of Deeds of Trust by Public Trustees. Sandy Hume agreed to provide the working for this statute.
Correct CRS 38-37-104(1)(b) describing how the Public Trustee’s fee is calculated.
Request the Colorado Bar Association draft legislation to resolve Foreclosures problems and allow the Public Trustee Legislative Committee to review the draft.
Invite Bob Holmes to participate at the Public Trustee Conference at Fall Seminar.
Introduce legislation to extend cure period and eliminate redemption period where Investors create expenses. Possibly involve the Consumer Protection Agency or AARP organization.
Is there a limit on Attorneys’ fees on Foreclosures? Ask Karen Castle @ Limon.
Send a letter of support for #5 above to Colorado Bar Association.
Prepare an agenda for discussion at Limon with Karen Castle and copy her prior to September 18 meeting at Limon.
Araphoe County has an issue with foreclosing attorneys coming to Public Trustee Foreclosure sales without monies in hand for bidding on sales. Araphoe and other Counties have requirement that monies must be in hand to participate in their Foreclosure sales. Perhaps add to Limon/Castle agenda?
Suggest a panel discussion at Fall Seminar on e-recording.
A list of discussion items will be prepared for the Limon meeting, Karen Castle, Speaker.
Karen Sheaffer will follow up with CCI and Eagle Board of Commissioners regarding proposed legislation governing Public Trustee accounting rules and oversight.
