CPTA Legislative Committee Meeting Minutes

1:30 p.m.

 The meeting was called to order at 1:40 p.m.  Committee members in attendance in person or by phone were Bob Sagel, Sandy Hume, Jill Voegtle, Angela Dazlich, Peggy Foley, and Debbie Wagner.  Stephanie O'Malley, the new Clerk and Public Trustee of the City and County of Denver, and J R Moore from her office also were in attendance.

The first item discussed was the joint Senate and House Committee hearing scheduled for Monday, January 22, 2007.  Bob is signed up to testify.  Peggy and Angela will attend to give additional testimony.  Jill will supply some copies of the timeline, prior years' statistics for the state and Denver's statistics up to and including an estimate for January, 2007.

HB 07-1157, the foreclosure clean-up bill has been assigned to the Judiciary Committee.  Debbie will coordinate with the sponsor, Rep. Garcia, to schedule a time for the first reading, hopefully by the end of January.  Debbie will begin putting together a fact sheet.  She and Bob will meet with State Treasurer Cary Kennedy later today to get her opinion of an amendment to include unclaimed redemption and cure payments in the Great Colorado Payback unclaimed property fund.

The committee voted to support SB 047-085, the Attorney General's bill granting additional consumer protections in real estate transactions.

The bill for setting the form for releases in statute has a sponsor and a title.  A draft should be available next week that will be sent to all interested parties.

The proposal to eliminate lienor redemptions will not make it to the Legislature this year.  The committee will work with the Bar Committee for next year's session.

Under Old Business, the Pre-sale payoff through the Public Trustee proposal and the recovery of "hardship loans" through the County Treasurer's Tax Lien Sale proposal will both stay on the agenda for future discussions. 

Under New Business, a proposal to incorporate all foreclosure fees into one flat fee will be added to future agendas.

At the Quadrennial training sessions next month in Caste Rock, Jack Arrowsmith will be reviewing the upcoming changes brought about by HB 06-1387.  Angela agreed to assist Bob with a session on Public Trustee finances.

The committee will need to coordinate with the Executive Board and the Manual Committee on training and materials for the Summer Conference.

Bob was asked to send a letter to the Senate Finance Committee supporting the nomination of Roxy Huber as Executive Director of the Department of Revenue.
