Legislative Committee Meeting Minutes
Jefferson County, January 28, 2005

 The CPTA Legislative Committee meeting was called to order at 1:30 pm at the Jefferson County Court House.  Those in attendance were Peggy Foley, Tina Whitmer, Jack Arrowsmith, Bob Sagel, Peg Ackerman, Debbie Wagner, Mary Schaefer, Sandy Hume, Mary Wenke, Jim Ventrello, and Jim Covington.

The first item of discussion was HB 05-1168, our “housekeeping” bill.  Two possible amendments to the introduced language of the bill were discussed, (1) clarifying the verbiage in Title 24 concerning the scope of UETA and (2) changes to the section concerning allowing public trustees to record a cancellation and termination.  Sandy expressed some concern about the Title 24 language but everyone agreed that the amendment should be sufficient at this time.  Due to an email message from Rich Krohn about the second amendment, it was decided that it should be pulled at this time.  Bob Sagel will contact Rich and ask him to discuss the matter further with the other members of the Real Estate Section of the Bar Association to see if they can come up with a viable compromise amendment to be addressed in the Senate.

Next the group discussed future legislative plans.  The committee was given a rundown of the reasons why the proposal to extend the cure period and eliminate the owner’s redemption period was not pursued this year.  There had been miscommunication between our representatives and the Bar committee and because of this, HB 1168 took much more time than had been planned on.  The committee wants to make this a priority for next year.  Suggestions included visiting with any other entities that will be affected by the legislation and try to get them on board in advance, pulling together State-wide foreclosure statistics, and pushing the proposal as a homeowner/consumer protection issue. The Bar committee has asked that the CPTA continue to meet with them on a monthly basis to come up with a rewrite of the foreclosure statutes but they would like to see this done separately from the cure extension proposal.  It was moved and seconded that unless there are compelling reasons, such as adverse financial market issues, that there will be only one legislative proposal from the Colorado Public Trustee Association next year.  This will include, at the least, the extension of the cure period and elimination of the owner’s redemption period.   Any and all other issues will be reviewed and may be added to this proposal.  The motion passed unanimously. 

Peggy Foley, Jeannie Reeser, and Bob Sagel have been meeting with the Bar committee since December.  Tina Whitmer and Jack Arrowsmith have recently joined the group.  Several other members volunteered to join with this joint committee.  The next meeting will be in the offices of Holmes, Roberts & Owens at noon on February 15, 2005.

It was decided that Bob Sagel and Peggy Foley would sign up to testify before the House Committee concerning HB 1168 on Monday, January 31.  Peg Ackerman and Debbie Wagner said they would be there and Jack Arrowsmith volunteered to attend if needed.  Jack will also contact Wayne Vaden to ask for his support and possible attendance.  (Note:  Peggy was unable to attend due to the weather conditions.  Bob, Peg, Debbie, Jack and Wayne attended.  Mary Wenke also came for support.  I would like to give a big THANK YOU to these people. – Bob)
