Legislative Session update
HB 07-1157 - Concerns were aired about the change which allows the attorneys to choose the newspaper for publication. Also, whether publications had to be in a newspaper located in the County of the foreclosure. Another item of concern was the penalty for failure to timely file a cure statement. The committee will look into possibly having these items clarified in the next Legislative session.
HB 07-1265 - Bradford Publishing hopes to have the new release forms ready by the first part of July.
SB 07-085 - The committee reviewed the portions that would affect Public Trustees and felt they were necessary and proper.
Old Business - The committee voted to remove the following items from future agendas:
Pre-sale pay-offs through the Public Trustee
Recodification of the Public Trustee statutes
Removal of a lienor's right to redeem
One flat fee for a foreclosure
New Business - Dianne Bailey suggested that we investigate reducing the number of sale notices required to be published for a foreclosure. It was decided that we target this for the 2009 session. Dianne will compile more figures in the interim.
The committee agreed to seek an increase in salary for the appointed Public Trustees. Carol Snyder reported that the Governor's office is generally supportive of the idea. She will work with Ackerman Information Services on getting a sponsor for the upcoming session.
Jim Covington will chair a subcommittee to look into the current fee structure and make recommendations to the Legislative Committee. Other members of the subcommittee are Karen Sheaffer, Ana Maria Peters-Ruddick and Dianne Bailey.
Rich Krohn updated the committee on some of the issues surrounding Home Owner Associations (HOA's) and some of their concerns with HB 06-1387. There are to be some meetings this summer between the affected parties. Margaret Chapman will be the Public Trustee Association's representative to these meetings. Carol Snyder will be her back-up.
Training sessions for Public Trustees and the public were discussed. Rich Krohn will handle the Grand Junction area. The Colorado Bar Association is having training at the Real Estate Symposium in Steamboat Springs on July 20th and again at the Bar Association offices in Denver around the middle of December. Bob will discuss setting up training sessions for Public Trustees with the Executive Committee.
Meeting adjourned at 4:00 p.m.
Respectfully submitted,
Bob Sagel, Chairman
(Thank you to Connie Joiner for taking notes.)
